By accessing or using Freebound's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

2. Description of Services

Freebound provides rapid prototyping and MVP development services for non-technical founders. Our services include market validation, working prototypes, and iteration support to help bring your SaaS ideas to life. The specific deliverables and scope of work will be agreed upon in a separate project agreement.

3. User Responsibilities

When using our services, you agree to:

  • Provide accurate and complete information about yourself and your project
  • Maintain the confidentiality of any account credentials
  • Notify us immediately of any unauthorized use of your account
  • Not use our services for any unlawful purpose
  • Not attempt to interfere with or disrupt our services
  • Comply with all applicable laws and regulations

4. Intellectual Property

Your Content

You retain ownership of all intellectual property rights in the ideas, concepts, and business plans you share with us. By engaging our services, you grant us a limited license to use this information solely for the purpose of providing our services to you.

Deliverables

Upon full payment for our services, you will own the custom code, designs, and other deliverables created specifically for your project, as outlined in your project agreement. We may retain the right to use general techniques, methodologies, and non-proprietary components in future projects.

Our Content

All content on our website, including text, graphics, logos, and software, is the property of Freebound and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.

5. Payment Terms

Payment terms will be specified in your individual project agreement. Generally:

  • A deposit may be required before work begins
  • Payments are non-refundable unless otherwise specified in your agreement
  • Late payments may result in suspension of services
  • All prices are in USD unless otherwise specified

6. Confidentiality

We understand the sensitive nature of your business ideas. We agree to keep confidential all proprietary information you share with us during the course of our engagement. This obligation of confidentiality does not apply to information that is publicly available, independently developed by us, or rightfully obtained from third parties.

7. Limitation of Liability

To the maximum extent permitted by law, Freebound shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of our services. Our total liability for any claims arising from our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

8. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our services will meet your specific requirements, achieve particular results, or be uninterrupted or error-free. We do not guarantee the commercial success of any prototype or MVP we develop.

9. Indemnification

You agree to indemnify and hold harmless Freebound and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of our services, your violation of these Terms, or your violation of any rights of another party.

10. Termination

Either party may terminate the service relationship in accordance with the terms of the project agreement. We reserve the right to terminate or suspend your access to our services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of our services after any changes constitutes acceptance of the new Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
